Terms of Use

These terms are an agreement between you and OnlineBoatDealer.com ("we"). By using this site you accept them. If you don't, please don't use the site.

What we are

We are an online venue where sellers list boats and buyers contact them. We do not own, inspect or sell the boats listed by others, and we are not a broker, dealer, lender, escrow agent, surveyor or party to any sale. Any deal is solely between buyer and seller.

Your account

You must be at least 18 and able to enter a binding contract. Give accurate information, keep your sign-in secure and tell us about any unauthorized use. You are responsible for activity on your account.

Listing a boat

When you publish a listing, you confirm that:

• you own the boat or are authorized to sell it, and you hold any license the law requires for your sale;
• the price, condition, hours, hull ID and other details are accurate, and you will mark the boat sold promptly;
• you own or have permission to use every photo and description, and they don't infringe anyone's rights.

You keep ownership of your content. You give us a non-exclusive, worldwide, royalty-free license to host, display, resize and promote it to operate and market the site, until you remove it or a reasonable time after.

Contacting sellers

By sending an inquiry, you authorize us to pass your details to that seller. Sellers may use buyers' details only to discuss that boat, and may not add them to marketing lists, autodialed calls or texts without separate legal consent.

Listing review

We may review, send back, feature or remove any listing. A verified seller badge means our team reviewed that seller's identity or business, not that we guarantee the seller or the boat.

Financing, surveys and closing

Financing requests are not loan applications or offers of credit. We are not a lender, broker, escrow agent, surveyor or legal adviser, and we do not hold funds. Buyers and sellers are responsible for their own inspections, paperwork and payment.

Alerts

You choose your email and text alerts in Account settings. Text alerts need your separate consent. Reply STOP to any text to opt out.

Valuations and trade estimates

Valuations combine what you send, market research assisted by AI, and review by our team. They are estimates, not offers, appraisals or guarantees of what a boat will sell for, and may change after inspection. A trade allowance is binding only in a separate written agreement with the dealer or buyer.

Factory direct offers

Factory direct prices and offers are set by the builder, may change, and are not a binding offer until confirmed in writing.

What's not allowed

• False, stolen, encumbered without disclosure, or illegal listings; fraud; or impersonating anyone.
• Spam, harassment, or collecting other users' information.
• Scraping, bots, interfering with the site, or getting around its security.

We may remove content, or suspend or close accounts, at our discretion, including when we suspect a violation.

Buying safely

Verify title, liens and the hull ID, get an independent marine survey and sea trial, and be wary of requests for wire transfers or deposits before you have seen a boat. Payment estimates on this site are illustrations, not loan offers. Value ranges are rough guides based on listings here, not appraisals.

Sample content and brand names

Listings marked "Sample" are illustrations and are not for sale. Brand names and logos belong to their owners and appear only to identify the make of a boat. Their appearance does not mean that any builder sponsors, endorses or is affiliated with this site unless we say so.

Disclaimers

The site and its content are provided "as is" and "as available," without warranties of any kind, including merchantability, fitness for a particular purpose and non-infringement. We don't guarantee any listing, user, sale or uninterrupted service.

Limits on liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, lost profits, or anything arising from a boat, a transaction or another user. Our total liability for any claim is limited to the greater of $100 or what you paid us in the prior 12 months. Some places don't allow these limits, so they may not fully apply to you.

Indemnity

You will cover our reasonable losses and costs from claims caused by your content, your transactions or your breach of these terms.

Governing law

Florida law governs these terms, without regard to conflict-of-law rules, and disputes belong in the state or federal courts located in Florida, unless the law where you live requires otherwise.

Changes and contact
